HUKA RIVER SWIM TERMS & CONDITIONS AND WAIVER

Please read this entire waiver carefully before signing or checking the box. Please note that

the event website may contain other terms and conditions that apply to the Event. By

participating in the Event, I also acknowledge my acceptance of the terms and conditions

set out on the Event website and within the Event’s online registration.

1. I understand that I should not compete in this event unless I have trained and

prepared appropriately for it, my physical condition has been verified by a medical

practitioner, I confidently believe that I am sufficiently fit and healthy to compete in

this event, and that I am able to tread water in a fatigued state for at least two

minutes.

2. I acknowledge that swimming involves the real risk of serious injury or even death

from various causes including overexertion, equipment failure, falling debris,

contact with structures, dehydration and/or accidents with other competitors.

3. I understand this is a river swim which involves currents, bends and dangers

associated with river swimming that are not typically found in ocean/open water

swimming.

4. By competing, I accept all risks necessarily flowing from my participation which

could result in loss of life or permanent injury. Accordingly, I release all persons or

corporations associated directly or indirectly with the conduct of the event from all

claims, demands and proceedings arising out of my participation and I hereby

indemnify them against all liability (including liability for their negligence and the

negligence of others) for all injury, loss or damage arising out of or connected with

my participation in this event. This release shall extend to and include Euphoria

Management Group Ltd and their respective directors, partners, managers, officers,

agents, contractors, employees and volunteers including medical and paramedical

personnel appointed for the event, the owners, licensees and occupiers of land upon

which the event or any part of it is conducted, any statutory body or local authority

having control over any land upon which the event or any part of it is conducted or

which is involved directly or indirectly with the event in any manner whatsoever and

promoters, sponsors and event organisers. This release and indemnity continues

forever and binds my heirs, executors, personal representative and assigns.

5. I accept that it is my responsibility to contact the event organisers should any

information on my entry form need to be updated e.g. emergency contact details or

medical details.

6. I understand that if I am entering a swim distance of 3.3km I am a competent

swimmer and am capable of swimming this distance without aid or support from

others.

7. I will follow the course set out for the event, abide by the event rules and follow

instructions given to me by the event organisers. Failure to comply may result in

disqualification and removal from the event.

8. I acknowledge that the event organisers will endeavour to provide a true and

accurate course distance, but the distance may vary due to river flows and

conditions.

9. I consent to receiving any medical treatment that the event organisers think is

necessary during or after the event.

10. I consent to the event organisers using my name, image, voice and likeness before,

during or after the event for event promotional purposes in any marketing media,

social media, official sponsor campaigns and for broadcasting or reporting purposes

in any media.

11. I consent to Euphoria Management Group Ltd providing my personal details to a

professional photography company if they are contracted by Euphoria Management

Group Ltd to take professional photographs of participants at the Event. The

contracted company may contact me via email to alert me when photos from the

Event are available to purchase via their website.

12. I understand that safety precautions undertaken by organisers (such as course

supervision, event safety briefing) are a service to me and other competitors but are

not a guarantee of my safety.

13. The safety briefing is compulsory for all participants. If for any reason i can’t attend

the safety briefing, I must notify the event organisers to arrange a briefing prior to

the event

14. I accept that I have an important responsibility to listen to all pre-event safety

briefings and to immediately seek clarification from an event official on anything

which is not entirely clear to me.

15. I am fully responsible for the security of my personal possessions at the event.

16. I shall not take part in any part of the event while under the influence of drugs

and/or alcohol

17. I understand that if for any reason the event is cancelled or stopped, or I cannot take

part in the event for which I have registered for any reason, I will only be eligible for

a refund as set out in the entry policies and withdrawal/refund dates stipulated on

the event website

18. I agree to abide by all event rules and directions issued by the event organiser. These

are listed on the website

19. I will wear the event timing chip as directed by the event organisers. I must return

the timing chip after the event (whether I participate or not) otherwise I will be

charged by the event organisers, and I agree to pay $50 for its non-return.

20. I agree to my name and contact details being included on the Euphoria Management

Group Ltd event and email database. Event specific email communications and

messages from event partners will be sent to me. I understand I have the ability to

unsubscribe from this at any time.

21. I acknowledge that by reason of circumstances beyond the control of the event

organisers, it may become necessary or desirable to change the format of the event,

and if that occurs, I consent to the changes and I agree that each and every one of

the conditions herein set out shall apply to that changed event.

22. Due to the committed outgoing costs, if the event is cancelled due to any ‘act of God

or nature’, strike, lockout, fire, flood, storm, explosion, revolution, riot, act of war,

earthquake, landslide, epidemic (including a pandemic), communicable disease,

national day of mourning or any other act or event that is beyond our reasonable

and foreseeable control, I understand that my entry fee may not be refunded.

23. I hereby certify that I am the minimum age or older as specified for the event. The

minimum age at event day is 12 years old.

24. I hereby certify that I am 16 years of age or older. (See below for younger

competitors)

25. If I am between the ages of 12 and 16 years of age, I will have these Terms and

Conditions viewed and agreed upon by my legal guardian (through the online entry

process), which will in effect give consent for me to compete in this event. Children

under the age of 16 wanting to compete in this event should have a high level of

ability and fitness, and must attend the pre-race safety briefing with their legal

guardian present.

26. I have read all the event safety information, rules and conditions detailed in this

waiver and on the entry form, and i agree to adhere to these rules and conditions at

all times
